Title IX: Non-Discrimination and Harassment in Education
Gender discrimination and sexual harassment are prohibited based on Federal Law Title VI of the Civil Rights Act of 1964 as amended and Title IX of the Education Amendments of 1972. The Hartwick College Policy prohibits sexual harassment or discrimination, in any form, in all programs and services. All students, faculty, staff and visitors to the College are expected to comply with this policy and adhere to a standard of conduct that is respectful of the rights of all individuals.
Types of conduct that constitute sexual misconduct include:
- Inappropriate or unwanted touching, hugging, patting or pinching
- Displaying sexually demeaning or offensive objects, pictures, posters, or drawings
- Physical assault, sexually coerced activity or unwelcome sexual advances
- Sexually suggestive jokes or innuendos
- Derogatory, degrading, sexist or lewd remarks about a person's body, clothing, or sexual activities
- Suggestive or insulting sounds, whistles, catcalls
- Obscene phone calls, gestures, emails or text messages
- Demands or subtle pressure for sexual favors
- Any type of sexual harassment based on sexual orientation or gender identity
- Retaliation for reporting sexual harassment, discrimination, or violence
Harassment is not limited to prohibited behavior by a male toward a female, nor by a supervisory employee toward a non-supervisory employee, nor a faculty to a student. The victim does not have to be the opposite sex of the harasser. The gender of the complainant and/or the alleged harasser is irrelevant, even if they are the same gender. Harassment may be student to student, faculty to student, student to faculty, faculty to staff, or any combination of student, faculty, staff or visitor.
Preventing discrimination, harassment and violence
Each member of the campus community is responsible for preventing discrimination, harassment and violence, and ensuring that the work and academic environments are harassment-free.
Reporting an Incident
Any student, faculty, staff or visitor who has been a victim of or a witness to and/or personally offended by discriminatory practices or behavior(s) may discuss their concerns and/or file an informal or formal complaint for possible violations of Title IX with the Title IX Coordinator.
What should you do if you believe you have been victim or a witness to harassment, discrimination or violence?
- Find out about the College's policy and procedures for handling offenses and follow them;
- Take action and get help - ignoring sexual harassment is not an effective way to stop it;
- Report the offensive behavior(s) to a faculty, staff, counselor, Title IX Coordinator, or administrator;
- Whenever possible, tell the harasser verbally or in writing what specific behavior(s) are offensive and ask him/her to stop;
- Keep a detailed record of behavior(s) to share with school officials who investigate your complaint.
Upon being contacted, the College Official will apprise the person reporting the offense of the College's policies and procedures, the rights of all parties, and the possible outcomes. An investigation will take place regardless of whether a formal complaint is filed. The investigation will be kept strictly confidential and the College may take interim actions pending the outcome of the investigation to protect and safeguard parties from further harassment or retaliation. Such action may include residence hall restrictions, course changes, suspension from employment, removal form campus or other appropriate actions.
